Terms of Service

1. Who we are

DishVote (the “Service”) is operated by Groupe Coda (“Groupe Coda”, “we”, “us”, “our”). By creating an account or using the Service in any way, you enter into a binding agreement with Groupe Coda on these terms.

2. Acceptance of these terms

By accessing or continuing to use DishVote you agree to these Terms of Service and our Privacy Notice. If you do not agree, do not use the Service.

You confirm that you are of legal age in your country and, if you are using the Service on behalf of an organization, that you have authority to bind it to these terms.

3. The Service

DishVote helps people discover the best dishes at restaurants through community votes, comments and curated lists. We offer a free tier and an optional paid “Premium” subscription with additional features such as diet filters, personal analytics and a verified badge.

4. Your account

You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date. Notify us if you believe your account has been compromised.

5. Acceptable use

You must not:

  • Use the Service for unlawful, fraudulent or abusive purposes;
  • Post spam, harassment, hateful content or content that infringes anyone’s rights;
  • Manipulate votes, ratings or rankings (including with bots, scripts or fake accounts);
  • Attempt to interfere with the security or integrity of the Service (probing, scraping at scale, malware, reverse engineering, circumvention of technical limits);
  • Resell, sublicense or redistribute access to the Service.

6. User content

You keep ownership of the content you post (votes, comments, lists, photos). You grant Groupe Coda a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute that content for the sole purpose of operating and promoting the Service. You are solely responsible for what you post and confirm you have the rights to post it.

We may remove or restrict content that breaches these terms, our community guidelines or applicable law.

7. Intellectual property

The Service, including its software, design, text, branding and the DishVote name and logo, is owned by Groupe Coda and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these terms.

8. Premium subscriptions, payments and refunds

Premium is sold on a recurring basis (monthly or yearly). Your subscription renews automatically at the end of each billing period until cancelled. You can cancel at any time from your profile or via Paddle’s customer portal; access continues until the end of your paid period.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and refund mechanics are governed by Paddle’s Buyer Terms and our Refund Policy.

9. Service availability

We work hard to keep DishVote running smoothly but do not guarantee that the Service will be uninterrupted, error-free or free of inaccuracies. Restaurant and dish data is community-contributed and provided as-is. Features may change as we improve the Service.

10. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these terms, fail to pay for a paid plan, create a security or fraud risk, or repeatedly violate our policies. You can stop using the Service at any time by deleting your account.

On termination, your right to use the Service ends immediately. Votes and content you contributed to the community may remain visible in aggregated form.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, Groupe Coda’s total aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special or exemplary damages, including loss of profits, data or goodwill. Nothing in these terms limits liability for fraud, gross negligence, death or personal injury where such limitation is not permitted by law.

13. Indemnity

You agree to indemnify and hold Groupe Coda harmless from claims arising out of your content, your unlawful use of the Service or your breach of these terms.

14. Changes to the Service or these terms

We may update the Service and these terms from time to time. If we make material changes we will give reasonable notice (for example, via the Service or by email). Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

15. Governing law

These terms are governed by the laws applicable at Groupe Coda’s place of establishment, without regard to conflict-of-law rules. The competent courts of that jurisdiction have exclusive jurisdiction over any dispute, subject to mandatory consumer protection rules in your country of residence.
